Abstract

[fr] Résumé :
L’OCDE et le G20 ont collaboré et mis en place le projet BEPS, « Base Erosion and Profit Shifting ». La cinquième action du projet va obliger les Etats à réformer les régimes de la propriété intellectuelle. Nous nous demandons si les Etats du Benelux peuvent saisir cette occasion pour promouvoir la fiscalité en matière de recherche et développement.
Pour ce faire, nous avons premièrement défini le projet BEPS de l’OCDE.
Deuxièmement, nous avons réalisé une étude comparative des différentes définitions existantes pour la notion de « frais de recherche et développement » ainsi que des différents incitants existant au sein de la Belgique, du Luxembourg et des Pays-Bas.
Troisièmement, nous avons interrogé quelques entreprises wallonnes afin de déterminer le traitement comptable des frais de recherche et développement.
Enfin nous avons tenté de répondre à notre problématique et de découvrir quelle était la compétitivité des Etats du Benelux en matière de recherche et développement.
Summary:
OECD and G20 collaborated to put in place the « BEPS » project, « Base Erosion and Profit Shifting ». The fifth action of this project will require from states that they reform their national IP regimes. We have investigated to determine whether Benelux’s member states could take this opportunity to promote the tax regime, as well as the relevant accounting provisions, applicable to research and development costs.
To do so, we have drafted an overview of the goals of the “BEPS” project.
Then, we performed a comparative study of the different definitions applicable to « costs for research and development » and of the different tax incentive that are in force in Belgium, Luxembourg and the Netherlands.
We interviewed companies established in Wallonia to discuss on how they account for their research and development costs.
As a conclusion and based on the above, we provided an answer to our problematic and tried to assess the level of competitiveness of the Benelux member states’ regulations in the field of research and development.
