Abstract
[fr] Une situation problématique émerge suite à l’entrée en vigueur de la loi du 05 mai 2014 relative à l’internement et à la modification de l’article 71 du code pénal : l’internement n’est plus applicable que pour les personnes présentant un trouble mental qui commettent des infractions menaçant ou portant atteinte à l’intégrité physique ou psychique de tiers, et désormais, seule une abolition totale des facultés mentales légitime l’acquittement. Qu’en est-il des personnes en marge de ces conditions ? La présente étude consistera à investiguer les possibilités de prise en charge judiciaires et médico-psycho-sociales pertinentes pour combler ce vide juridique. Nous avons relevé parmi les dossiers de la chambre de protection sociale de Liège les profils de 15 internés ayant commis des faits "mineurs" avant l’entrée en vigueur de la nouvelle loi, afin de créer une vignette clinique illustrant un cas représentatif sur base duquel nous avons interrogé 19 intervenants gravitant autour des personnes internées (magistrats, avocats, psychologues, psychiatres...). Si la peine de probation est considérée par les intervenants comme étant la meilleure alternative dont nous disposons actuellement, notre recherche fait néanmoins état d’une série d’obstacles à son application concrète.
[en] A problematic situation emerges following the entry into force of the law of May 5, 2014 relating to the internment and the modification of article 71 of the penal code : the internment is more applicable only for the persons presenting a mental disorder who commit offenses threatening or harming the physical or psychological integrity of others, and henceforth, only a total abolition of mental faculties legitimizes the acquittal. What about people outside these conditions ? The present study will investigate the possible judicial and medico-psycho-social alternatives relevant to fill this legal vacuum. We found among the files of the social protection chamber of Liege the profiles of 15 internees who committed "minor" acts before the entry into force of the new law, in order to create a clinical vignette illustrating a representative case on the basis of which we interviewed 19 speakers around internees (magistrates, lawyers, psychologists, psychiatrists ...). While probation is considered by professionals interviewed as the best alternative we currently have, our research nevertheless points to a series of obstacles to its practical application.
