Abstract

Ce travail a pour objet d’analyser l’émergence d’une « norme de concurrence » dans le gouvernement des conduites à la lumière du concept de gouvernementalité néolibérale. À cette fin seront présentés d’une part, le phénomène de concurrence des normativités juridiques en droit des sociétés, et, d’autre part, un phénomène de concurrence entre des normes juridiques et un autre type de normativité (les normes I.F.R.S). Ensuite, dans une deuxième partie, ces phénomènes seront mis en perspective avec le concept foucaldien de gouvernementalité, puis avec l’influence ordolibérale de la construction européenne et enfin avec une analyse de la norme de concurrence dans les politiques économiques, publiques et de société des États.

The purpose of this work is to analyse the emergence of a "competition norm" in the governance of conduct in the light of the concept of neoliberal governance. To this end, the phenomenon of competition between legal norms in company law will be presented on the one hand, and on the other hand, the phenomenon of competition between legal norms and another type of normativity ( the I.F.R.S. norms) will be explained. In a second part, these phenomena will then be put into perspective with the Foucaultian concept of governmentality, then the ordo liberal influence of European integration and finally an analysis of the norm of competition in the economic, public and social policies of the States.
