Abstract
[fr] L'industrie mondiale du jeu vidéo est devenue l'industrie culturelle qui génère le plus de
revenus. Malheureusement, la Belgique peine à tirer son épingle du jeu. C'est pourquoi, suite à
la pression des lobbys de cette industrie, le législateur a décidé en 2019 de lui ouvrir le champ
d'application du Tax Shelter.
Ce travail se base essentiellement sur une recherche documentaire. Son objectif est de permettre
au lecteur de prendre connaissance du Tax Shelter, souvent considéré comme complexe et d'en
comprendre son fonctionnement sur le plan fiscal, civil et comptable. Etant axé sur la récente
ouverture du champ d'application de l'incitant aux jeux vidéo, le présent ouvrage a également
pour objectif d'en exposer ses particularités.
Ce travail expose et analyse les différentes étapes liées au Tax Shelter.
Il traitera d'abord d'une analyse économique brève du secteur vidéoludique belge.
Le reste du travail abordera le Tax Shelter en profondeur. Pour ce faire, il analysera les parties
intervenantes ainsi que les conditions liées à la convention-cadre. L'agrément obligatoire de
l'œuvre par les Communautés sera également traité.
Une large partie du mémoire sera également consacrée à l'étude des avantages que peut conférer
ce mécanisme. Il s'agira d'une analyse tant de la rémunération de l'investissement que de
l'avantage fiscal offert par l'incitant. La problématique des dépenses qualifiantes sera également
explorée.
De plus, cet ouvrage développera la manière dont cet incitant doit être traduit dans la
comptabilité de l'investisseur et du producteur.

[en] The global video game industry has become the most revenue-generating cultural industry.
Unfortunately, Belgium is struggling to take advantage of it. This is why, following pressure
from the industry's lobbies, the Belgian legislator decided in 2019 to open up the scope of the
tax aid scheme named "Tax Shelter" in order to help this industry.
This thesis is essentially based on documentary research. Its objective is to enable the reader to
become acquainted with the Tax Shelter aid, often considered as complex, and to understand
how it works from a tax, civil and accounting point of view. As it focuses on the recent opening
of the scope of application of the incentive to video games, this publication also aims to explain
its specificities.
This work explains and analyses the different stages linked to the Tax Shelter.
It will first give a brief economic analysis of the Belgian video game sector.
The rest of the work will approach the Tax Shelter in depth. In order to do so, it will analyse
the parties involved and the conditions linked to the contract. The compulsory accreditation of
the work by the Communities will also be dealt with.
A large part of the paper will also be devoted to the study of the advantages that this mechanism
can confer. This will involve an analysis of both the return on investment and the tax advantage
offered by the incentive. The issue of qualifying expenses will also be explored.
In addition, this thesis will develop the way this incentive must be incorporated into the
accounting of the investor and the producer.
Finally, this work will conclude with the author's personal opinion on this mechanism.
